This is a legally binding liability release, waiver, discharge and covenant not to sue (the "Release"), made by me, the undersigned, to Jimmy Tat Jiu Jitsu LLC, (the "Club"), to the instructors of the Club (the "Instructors"), to the Landlord ("Landlord") and the members of the Club (the "Members").

I, {name}, fully recognize that there are dangers and risks to which I may be exposed by joining the Club and participating in jiu-jitsu, which is a martial art and involves strenuous physical activity and extensive physical contact with other people and a mat, including but not limited to joint locks, throws, chokes, strikes, ground fighting, and other similar activity. I acknowledge, agree and understand that fitness, sports, martial arts activities may involve vigorous exercise and strenuous exertion and contains the risk of injury such as, (but is not limited to) minor injuries such as scrapes, strains, and bruises, as well as significant injuries such as eye injury or loss, concussions, paralysis, and even death arising from my or others use of exercise equipment and machines; injuries arising from my participation or other's participation in supervised or unsupervised activities or programs; injuries and medical disorders arising from exercising such as hearth attacks, strokes, broken bones, torn muscles and ligaments among others; and accidental injuries occurring within the facility or during activity conducted outside the facility.

COVID-19:  Jimmy Tat BJJ LLC is open and operating based upon the guidance of the state of California and local authorities. The best practices advised by the Centers for Disease Control and Prevention (CDC), and state and local authorities to mitigate the risk of infection and operate as safely as possible have been implemented and are being followed.  As the facts about COVID-19 continue to evolve, Jimmy Tat BJJ LLC will continue to be guided by federal, state, and local authorities, and implement best practices accordingly.

I acknowledge that Jimmy Tat BJJ LLC is guided by state and local mandates regarding COVID-19.  I also acknowledge the contagious nature of COVID-19, and that despite the best efforts of Jimmy Tat BJJ LLC and adherence to federal, state, and local guidelines, I may be exposed to or infected by COVID-19 by attending Jimmy Tat BJJ LLC, and that the risk of being exposed to or infected by COVID-19 at Jimmy Tat BJJ LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to the owners, instructors, program participants, and family members of Jimmy Tat BJJ LLC. 

With full understanding of the risks involved and despite this Release, I am voluntarily joining the Club and I am willing to participate in jiu-jitsu.

I therefore agree to assume and take upon myself all of the risks and responsibilities in any way associated with this activity. In consideration of and in return for services, facilities, and other assistance provided to me by the Club, the Instructors and the other Members in this activity, I release the Club, its agents, the Instructors, the Landlord and the Members from any and all liability, claims and actions that may arise from injury or harm to me, from my death or from damage to my property in connection with this activity. I understand that this Release covers liability, claims and actions caused entirely or in part by any acts or failures to act by the Club, its agents, the Instructors, the Landlord and the Members, including but limited to negligence, mistake, or failure to supervise.

I recognize that this Release means I am giving up, among other things, rights to sue the Club, its agents, the Instructors, the Landlord and the Members for injuries, damages, or losses I may incur while participating in this activity. I understand that this waiver and release applies to this visit and any and all subsequent visits. I also understand that this release binds my heirs, executors, administrators, and assigns, as well as myself.

I further agree to hold harmless and indemnify Jimmy Tat Jiu Jitsu LLC for and against any claims brought on my behalf or by / on behalf of, any third party that are in any way related to my conduct, my injuries, my actions, my medical conditions, or my refusal to act.

MEDICAL COSTS:  I understand that Jimmy Tat BJJ LLC will not be responsible for any medical costs associated with any injury or illness  that I may sustain.

IMAGE/VIDEO RELEASE:  I authorize the use and disclosure of my name, photo- graphic/video images, and/or testimonial for marketing purposes by Jimmy Tat BJJ LLC. The photographic/video images, and/or testimonial will be used for: Social Media and/or Advertising.  Participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with training at Jimmy Tat BJJ LLC can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time.

By signing below I acknowledge that I have read the entire Release, and know, understand, and appreciate the potential dangers associated with my participation in the Club and use of the facilities and equipment, and freely and voluntarily enter into this agreement. I UNDERSTAND THAT BY SIGNING THIS WAIVER AND RELEASE I AM GIVING UP LEGAL RIGHTS OR REMEDIES THAT OTHERWISE WOULD BE AVAILABLE TO ME.
